We are Tag Search Limited and our registered office is at Solo House, The Courtyard, London Road, Horsham, West Sussex, RH12 1AT in the United Kingdom.  We can be contacted through our website at http://www.tagseasy.com.

These terms of use apply to your use of Tagseasy .  If you or your employers have purchased the Tagseasy service from Us under a separate agreement, the terms of that agreement will apply if there is any inconsistency.

If you use Tagseasy then you are accepting that these terms of use apply to you. If you breach these terms of use then we may suspend and/or terminate your account.

Your data

The data that we collect and what we do with it is described in our Privacy Policy.  By using Tagseasy you accept that our Privacy Policy applies to you.

Use of Tagseasy

You may use the Tagseasy for non-commercial purposes, provided that you do so in accordance with these terms of use and any guidelines and other site policies that we impose from time to time. 

We make the Tagseasy service available to you on an “as-is”, “where-is” basis and we reserve the right to stop providing this service and/or to charge for it at any time.

Content

We do not police or monitor content that other users of Tagseasy might upload or any websites that such users might tag.  We are not responsible for such content and websites and you should be aware that such uploaded content and/or websites may contain inappropriate, offensive or illegal information.  Please report any such contraventions of our terms of use in accordance with our complaints policy.

We operate a [Complaints Policy] for copyright owners and other people affected by the content posted on Tagseasy.  It shall not be a breach of our responsibilities to you if we comply with our Complaints Policy

Your Tags and Content

You must not:

• tag web pages that contain; or
• upload

content that is (i) illegal; (ii) defamatory; (iii) pornographic; (iv) offensive and/or (v) infringing of the intellectual property rights of a third party.

If you do not own the content that you tag and/or upload you must make sure that you are permitted by the owner to tag it and/or upload it.  Site owners often publish policies on linking to a page other than the home page of their site, and you should abide by any such policy. –

By sharing your tag books you are giving us permission to make the tags within your books available to those people with whom you have agreed to share.

You may remove tags and content that you have uploaded at any time.  However doing so may not remove such tags and/or content from any backups that we may have taken.  You acknowledge and accept this limitation.

Trade Marks and Intellectual Property Rights

The Tagseasy logo and the website (other than user-contributed content and tags) is our intellectual property.  Other than as permitted by these terms of use or by law, you may not use any of our intellectual property without our prior written consent.

Disclaimer of Warranties

Your use of Tagseasy is at your own risk.  We are not responsible for any harm that you may suffer as a result of your use of Tagseasy Toolbar, including, without limitation, any loss of data that you may incur. You can print out a list of the tags that you have stored and we advise you to do this at regular intervals.

We give no warranties whatsoever in relation to Tagseasy and to the greatest extent that We are permitted to do so by applicable law, We hereby disclaim all express and implied warranties including all warranties relating to its functionality, performance and its fitness for purpose, merchantability and/or its non-infringement of other people’s intellectual property rights.  We do not warrant that Tagseasy will be available at all times, or will function in an error free manner.

Our Liability to You

To the maximum extent permitted by applicable law, We will on no account be liable to you for any loss that you may suffer as a result of your use of Tagseasy, including, without limitation, any loss of profit, indirect and consequential loss, punitive and/or exemplary damages in each case howsoever arising and under any head of law, including without limitation, contract law and the law of tort and even if we may have been aware of the possibility of that you may suffer such loss.  You are free to stop using Tagseasy at any time.

For all other liability, or to the extent that the above sub-clause is held to be invalid for any reason, our maximum liability to you in aggregate shall be £5 or the equivalent in the currency of your local jurisdiction.

Interpretation and Governing Law

These terms and conditions are intended to be construed by and interpreted in accordance with English law, without regard to the English law provisions of conflict of law nor of your jurisdiction if you are not in England.  Any claim under this Agreement must be made in the courts of England and Wales.
If any part of these terms and conditions are found by a court of competent jurisdiction to be void or unenforceable for whatever reason, that part shall be deemed removed from these terms and conditions and the remainder of these terms and conditions shall remain in force.
